Extradition Law

Kira Hemkendreis is an attorney at Schlun & Elseven Rechtsanwälte PartG mbB. She advises and represents clients in criminal law, business criminal law and extradition law. She handles all phases of criminal proceedings, from investigation through trial, including complex business criminal matters. Her defense approach focuses not only on the current proceedings but also on the long-term personal and professional consequences for her clients.

Defense in Investigation Proceedings

Ms. Hemkendreis represents defendants in the earliest stages of criminal investigations. She analyzes charges, reviews investigation files and develops defense strategies. Through prompt responses and precise preparation, she works to influence proceedings at the preliminary stage by making timely statements, filing applications for file inspection, or submitting motions for case dismissal. Her objective is to protect clients from unnecessary interventions and establish the best possible position for further proceedings.

Trial and Court Proceedings

Ms. Hemkendreis represents clients throughout trial proceedings. She prepares evidentiary motions and develops defense strategies aimed at achieving acquittal, dismissal, or a significant reduction in sentence.

Following a judgment, Ms. Hemkendreis evaluates whether appeals (Berufung) or revisions (Revision) are viable. She analyzes judgments for legal errors and develops appeal strategies. She also advises clients on matters relating to sentence execution, including suspension of imprisonment on probation, early release and credit for pretrial detention.

Ms. Hemkendreis represents clients facing charges of fraud, breach of trust, or other property offenses. She analyzes complex business matters, examines business relationships and contractual structures, and develops defense strategies that account for both economic reality and criminal law elements.

In tax criminal law, Ms. Hemkendreis advises clients facing charges of tax evasion or other tax-related offenses. She evaluates whether voluntary disclosure, which eliminates criminal liability, is appropriate, manages tax investigation audits, and represents clients in criminal proceedings for tax offenses. She works closely with tax advisors and auditors to develop comprehensive defense strategies that address both tax law and criminal law aspects.

For charges involving corruption, bribery, or acceptance of benefits, Ms. Hemkendreis represents both individuals and companies. She analyzes business relationships, evaluates the substance of allegations, and develops strategies to limit damage. Her focus extends beyond criminal defense to protecting clients’ professional reputations.

Ms. Hemkendreis also provides comprehensive advice and defense in insolvency-related criminal matters. She advises on criminal law risks associated with business crisis situations and develops strategies to avoid or mitigate criminal consequences. Her work provides entrepreneurs facing difficult situations with legally secure paths forward and protection against excessive allegations.

European Arrest Warrant

Ms. Hemkendreis represents individuals in proceedings based on European Arrest Warrants. She evaluates the formal and substantive requirements for extradition, identifies potential bars to extradition, and develops defense strategies to prevent or delay extradition proceedings. She focuses particularly on fundamental rights, including the right to a fair trial, protection from inhuman treatment, and the right to respect for family life. Through her knowledge of European extradition law and international network, she handles cross-border cases effectively.

Extradition Requests from Non-EU States

For extradition requests from states outside the European Union, Ms. Hemkendreis advises clients on the legal and political dimensions of the proceedings. She evaluates whether the requirements of bilateral treaties are met, whether political persecution exists, or whether extradition would violate public policy. Her objective is to protect clients from unlawful extraditions and ensure adherence to rule-of-law standards.

Extradition Detention

Ms. Hemkendreis assists clients held in extradition detention. She works to secure their release as quickly as possible, whether through revocation of detention orders, suspension of extradition detention, or alternative measures. She evaluates whether detention requirements continue to exist, whether less severe measures would suffice, and whether detention duration is proportionate. Her work protects clients’ fundamental rights and preserves their personal freedom to the greatest extent possible.

Kira Hemkendreis studied law at the Universities of Trier and Bonn. She completed her legal clerkship in the Higher Regional Court district of Cologne, including placements at the Regional Court of Bonn, the Public Prosecutor’s Office in Bonn, and the Bonn Police Headquarters. She also worked at a law firm in Australia during her clerkship. After completing her second state examination, she worked for two years at a law firm in Cologne, where she gained experience particularly in business criminal law, tax criminal law, and compliance.

Ms. Hemkendreis is currently pursuing her doctorate in business criminal law.
