Where Delays Occur: Two Distinct Stages

Family reunification to Germany typically involves two separate authorities, each operating on its own procedures and timelines. Identifying which stage a delay has arisen at is the starting point for any legal response, because the available remedies differ accordingly. Delays arise across the full range of family reunification cases — including spouse and registered partner visas, child reunification, EU Blue Card family reunification, and parent reunification with adult children.

The German mission abroad
The process begins at the German embassy or consulate in the applicant’s country of residence, where the national visa for family reunification must be applied for. The officially stated processing time at German missions abroad is routinely exceeded in practice. Delays at this stage may result from high application volumes, security clearance procedures, document verification, or internal administrative backlogs. Because applicants are outside Germany at this stage, options for direct legal intervention are more limited, but a formal status inquiry and, where necessary, a supervisory complaint remain available.

The Ausländerbehörde (local foreigners authority)
Once the family member enters Germany on a national visa, the residence permit itself is issued by the local Ausländerbehörde. Delays at this stage can arise from understaffing, appointment availability, incomplete documentation requests, or failures of internal coordination. Where a residence permit has been applied for, and the authority has not yet decided, the Fiktionsbescheinigung (probationary certificate) preserves the applicant’s legal status in the interim – but only if it is issued promptly. Delays in issuing this certificate create serious practical difficulties even when the underlying right of residence is not in question.

In some cases, the Ausländerbehörde is also involved earlier in the process through the Vorabzustimmung – a preliminary approval issued by the local authority that can be sought to facilitate the visa procedure at the mission abroad. Delays at that stage are subject to the same legal remedies as delays in the residence permit procedure itself.

The Escalation Sequence: Legal Remedies for Family Reunification Delays

German administrative law provides a structured series of remedies for situations in which authorities fail to act within a reasonable timeframe. These tools work best as a sequence: each step creates a documented record and signals intent, strengthening the position for the next stage if the authority remains unresponsive.

Formal Status Inquiry (Sachstandsmitteilung)

A Sachstandsmitteilung is a formal request for a status update on a pending application. Any applicant can write to the responsible authority to inquire about the current status of their case. When submitted by a lawyer, however, the request carries a different weight: it is formally worded, establishes a clear deadline for response, and begins the documentation trail that will be relied upon if further steps become necessary.

In many cases, a well-timed Sachstandsmitteilung from legal counsel is sufficient to prompt the responsible authority to prioritize the application. Immigration offices are aware that legal representation signals preparedness to pursue all available remedies, and formal legal involvement often produces a response where informal inquiries have not.

Lawyer’s Letter and Formal Deadline

If the Sachstandsmitteilung does not produce a timely response, the next step is a lawyer’s letter formally setting a defined deadline for the authority to act. This transforms an informal delay into a documented legal matter with defined expectations and consequences for non-compliance.

At this stage, the delay is no longer simply an administrative inconvenience – it is recorded as a potential violation of the authority’s legal obligations under the Verwaltungsverfahrensgesetz (the German Administrative Procedure Act), which requires that applications be processed within a reasonable timeframe and that applicants be kept informed of the status of their case.

Supervisory Complaint (Fachaufsichtsbeschwerde)

Where an authority remains unresponsive despite formal communication, a Fachaufsichtsbeschwerde can be filed with the supervisory body responsible for overseeing that authority. This is a complaint directed at the next higher authority in the administrative hierarchy – for instance, the relevant state ministry or internal supervisory structure overseeing the responsible immigration office – calling for a review of the authority’s conduct or inaction.

It is worth understanding what this instrument targets. A Fachaufsichtsbeschwerde concerns the substantive correctness and lawfulness of an administrative decision or failure to act – not the personal conduct of any individual official. A complaint about an official’s manner or attitude would be a Dienstaufsichtsbeschwerde; a complaint that the authority is failing in its legal duties falls under the Fachaufsichtsbeschwerde.

The practical advantages of this tool in delay cases are significant. It is an informal instrument: no prescribed form is required, no filing fees are incurred, and no fixed deadlines apply – though acting promptly is advisable. It is not a court proceeding and does not replace the right to pursue court remedies; the two can run in parallel if circumstances warrant. The supervisory authority may confirm the existing administrative conduct, instruct the responsible body to correct the identified failing, or make recommendations for how the matter should be handled going forward. While there is no guaranteed right to any specific outcome – the supervisory authority exercises its own discretion – a formally lodged Fachaufsichtsbeschwerde by legal counsel carries real weight and frequently prompts action where direct communication has not.

Failure-to-Act Lawsuit (Untätigkeitsklage)

If prior steps have failed to produce a decision, the Untätigkeitsklage – an action for failure to act – allows the matter to be brought before the administrative court. Under German administrative law, this action may be filed once three months have passed without a decision on the application.

It is important to understand what the Untätigkeitsklage does and does not do. The court does not examine the merits of the underlying application – it does not decide whether the family reunification visa should be granted. Instead, it examines whether the authority has fulfilled its basic duty to reach a decision within a reasonable time and, if not, orders the authority to do so within a specified period. A successful Untätigkeitsklage does not guarantee a positive outcome, but it does guarantee that the indefinite waiting will end.

A further practical advantage is that, where the authority finally reaches its decision only after proceedings have been initiated, the authority will typically bear the costs of the lawsuit. Our immigration lawyers assess the prospects and costs with clients transparently before any action is filed.

The Fiktionsbescheinigung in Family Reunification Cases

Where a family member has entered Germany on a national visa and has applied for a residence permit before that visa expires, Section 81(4) of the Aufenthaltsgesetz (the German Residence Act) provides that the previous residence title continues to be treated as valid until the immigration authority reaches its decision. This is known as the Fortgeltungsfiktion – the provisional continuation of the existing title. The Ausländerbehörde is obligated to issue a Fiktionsbescheinigung (probationary certificate) documenting this continued right of residence.

When the Ausländerbehörde is slow to act, this certificate is often not issued in time. The consequences are serious in practice: employers may decline to accept the residence status, travel outside Germany becomes problematic, and dealings with other authorities stall – even though the underlying right of residence has not lapsed.

Where the Ausländerbehörde is not issuing the Fiktionsbescheinigung promptly, legal intervention can enforce timely issuance. Delays that have persisted for months often receive attention following a single formal deadline-setting letter.

Beyond the immediate effect on the authority, legal involvement provides structured protection throughout the process: deadlines are tracked, documentation is maintained in a form usable in court if needed, and the risk of procedural errors that could affect the underlying application is reduced.

The decision to escalate to a Fachaufsichtsbeschwerde or an Untätigkeitsklage is always made in consultation with the client after a clear assessment of prospects and costs.
