German Immigration Authorities: Legal Support for Delayed Applications

German immigration authorities process a substantial volume of applications annually, and administrative delays can occur for various reasons. These delays may affect visa applications, residence permit renewals, citizenship applications, and other immigration matters. When processing times exceed reasonable expectations, applicants may find themselves in difficult situations — unable to travel, begin employment, or make important life decisions.

Legal Remedies: The Untätigkeitsklage and Other Options

German administrative law provides legal remedies when authorities fail to process applications within appropriate timeframes. The Untätigkeitsklage (inaction lawsuit) is one such remedy, allowing applicants to compel authorities to make a decision on pending applications. This legal instrument becomes relevant when an immigration office has not decided on an application despite sufficient time having passed since submission.

Beyond the Untätigkeitsklage, other legal options may be available depending on the specific circumstances of your case. These can include requests for interim legal protection, formal objections, and direct communication with supervisory bodies. Our immigration lawyers assess each situation individually to determine the most effective approach for advancing your application through the administrative process.

City-Specific Immigration Office Challenges

Different Ausländerbehörden across Germany operate under varying administrative pressures and organizational structures. While all offices follow federal immigration law, practical experiences can differ by location.

  • The Munich Ausländerbehörde handles applications for one of Germany’s largest metropolitan areas, with demand often reflecting the city’s strong economy and international business presence. Applicants may encounter extended processing times during peak periods.
  • The Berlin Landesamt für Einwangerung (LEA) serves Germany’s capital and its diverse international population. The office manages a high volume of applications across numerous visa categories, which can affect processing timelines.
  • The Hamburg Ausländerbehörde processes immigration matters for residents of Germany’s second-largest city. As a major port city with significant international trade links, Hamburg attracts professionals from across the world.
  • The Düsseldorf Ausländerbehörde serves a region with strong international business ties, particularly in finance, trade, and Japanese business communities. Application volumes can reflect the city’s position as a corporate hub.
  • The Cologne (Köln) Ausländerbehörde handles immigration matters for one of the Rhineland’s major urban centers. Like other large city offices, administrative capacity can be affected by application volumes and staffing considerations.

Our legal team maintains experience working with immigration authorities across Germany and can provide guidance regardless of which office handles your application.

German Citizenship Applications

The two most common routes to German citizenship are through descent and residency. Both processes demonstrate the importance of Germany to the individual, whether this is through their familial links to the country or because they have made Germany their new home. For many individuals, their familial ties are significant for self-discovery. Knowing where our family comes from allows them to appreciate who they are.

German citizenship by residency (naturalisation) allows people born outside of Germany to become German citizens due to them residing in Germany. Citizenship is not a requirement to live and work in Germany. Still, it provides many benefits, such as voting rights and the ability to remain in Germany permanently, which means that visas and resident permits are no longer required.

Employment-based German Visas

If you are determined to move to Germany for employment purposes, our team of immigration lawyers will provide the legal counsel and assistance needed. Our team advises on options available to skilled workers under the recent Skilled Immigration Act, supports companies with ICT Card processes and consults with clients regarding various visas. Our team supports businesses by overseeing ICT Card applications for the entire company and will provide reliable legal advice relating to accelerating applications under the Skilled Immigration Act.

For freelancers and digital nomads, our team is here to assist them with the options available to them, such as the German Freelance Visa. This visa allows freelancers, self-employed individuals and digital nomads to establish themselves and reside in Germany. However, it is not the only option available to those in this position. A meeting with our team will allow them to outline your options relating to starting a business in Germany, avoiding “fake” self-employment (“Scheinselbstständigkeit”) and whether they may be eligible to apply for the EU Blue Card.

EU Blue Card Applications in Germany

The EU Blue Card is designed for high-earning individuals from third countries and those in fields with employee shortages. Applicants need to fulfil the following conditions:

  • possession of a German or an accredited foreign university degree comparable to a German one.
  • an offer of a job in Germany that reaches the required earning limits– or
  • an offer of a job in an area where workers are being sought for in Germany (scientists, mathematicians, engineers, doctors and IT-skilled workers) which has a lower earning requirement.

The holder of such an EU Blue Card may stay in the EU for up to four years and there are also increased prospects regarding a potential permanent settlement permit and family reunification. Should an EU Blue Card holder demonstrate the required German language requirements (B1 standard) they can accelerate their claim to German permanent residency. Our team of German immigration lawyers will advise you on all questions concerning the EU Blue Card in Germany.

Family Reunification in Germany

Living in Germany can be challenging for those unfamiliar with the culture and language. However, having loved ones nearby can significantly ease the transition. Permanent Residency in Germany: Applications and Other Legal Issues

The German permanent residence permit is an unlimited residence title granted to a foreigner to consolidate their residence in Germany. It allows them to live and work in Germany without restrictions, whether as employee or in self-employment. Additionally, permanent residency grants its holder freedom of movement, which allows them to enter and leave the country at any time and without the restrictions in place for other visas and residence permits.

Permanent residency can come about in several manners, and eligibility for permanent residence is based on the residence permit that the individual used to come to Germany. The EU Blue Card, for example, grants its holder permanent residency in under four years, and can even provide permanent residency after 21 months, should its holder reach the required language standards. Our expert legal team at Schlun & Elseven Rechtsanwälte provides personalised support tailored to your specific circumstances. We assist with understanding the eligibility requirements, which can vary based on factors such as employment status, duration of stay, language proficiency, and integration efforts.

Permanent residency should be considered a “must-have” for those who seek to stay long-term in Germany. However, it is worthwhile consulting with an experienced legal professional when making your application. Our Schlun & Elseven team will outline the requirements for German permanent residency and will oversee your application.

Residence Permits for Athletes, Commuters and Doctors

There are special visa options for athletes, doctors, and commuters. Under German law, cross-border commuters are citizens of third countries who work in Germany but reside in a neighbouring state and return there at least once a week. For such employees, difficulties can arise relating to social security, tax liability and vehicle registration. Section 12 Aufenthaltsverordnung (the Residence Ordinance) provides a border-crossing certificate designed to make it easier for border crossing commuters to obtain a residence title and an employment permit in Germany.

Regulated professions, including doctors, nurses, pharmacists, architects and teachers, are all recognised as needing extra standards when entering Germany to work. The German health and education systems are often understaffed, and there is a demand for outside experts to come to Germany. However, education systems vary between different states. Therefore, Germany needs to ensure that the professional qualification level of those entering the system is at the required standard. For this reason, a new recognition procedure for foreign professional qualifications of non-EU citizens and EU citizens was introduced under Section 17a  German Residence Act in conjunction with the Professional Qualification Assessment Act to Germany in 2015.

Short-Term Visas: Schengen Visa & Business Visa Applications

As the most powerful economy in Europe, Germany is a hub of business activity, and the use of short-term visas are often needed for those outside of the European Union Our lawyers advise our clients regarding the most suitable form of short-term visa (whether it is a Schengen Visa or a Business Visa). Short-term visas can be used for a variety of purposes, such as for business meetings, trade conferences, sporting events, entertainment matters, for family visit and for other reasons.  Our lawyers work with people making their way to Germany on a daily basis and will provide clear guidance with preparing the application, ensuring that deadlines are not missed and  that the correct documents are submitted to the appropriate offices.

Our team is also available to provide full-service legal assistance should there be any disputes or legal issues arising due to the Schengen/Business Visa. It may be necessary for you to stay longer due to unforeseen events, and our team will provide the guidance and support needed in extending your stay. It should also be noted that the German authorities can be slow to assess individual cases, and therefore, delays can be damaging to you. Staying in Germany beyond the period of your visa or residence permit can lead to significant legal problems. If you require legal service in matters concerning short-term visas to Germany, please do not hesitate to contact our team directly.

Furthermore, our German visa lawyers are ready to advise you regarding the German Medical Treatment Visa. This visa allows non-Germans and non-European Union citizens to come to Germany for medical treatment. Whether it concerns transport, translation, accommodation or other aspects, Schlun & Elseven Rechtsanwälte offers you the comprehensive service you need.

An Overview: Frequently Asked Questions about Immigration Law

Business Immigration encompasses all legal aspects of immigration related to business activities – including the recruitment of qualified professionals, corporate relocations, investor activities, and business formations. As Europe’s strongest economic power, Germany attracts international business activities, but the associated immigration processes are often complicated and lengthy. Schlun & Elseven Rechtsanwälte serves as a specialized partner in applying for visas and residence permits for employees and supports companies looking to relocate to Germany or establish a subsidiary or branch office. Through our experience in dealing with authorities, we ensure accelerated application procedures.

The EU Blue Card is a special residence permit aimed at highly qualified persons from third countries and professionals in shortage areas. Requirements include a German or recognized foreign university degree and a job offer that meets the required salary thresholds. Lower salary thresholds apply for natural scientists, mathematicians, engineers, doctors, and IT professionals. The main advantages: four-year EU residence, accelerated paths to permanent residence (after just 21 months with B1 language skills or at the latest after four years), and improved opportunities for family reunification.

Various options are available for work purposes: visas for job seekers for professionals, ICT cards for employees transferred within companies, residence permits for workers and investors, as well as freelancer visas for self-employed individuals and digital nomads. We advise on the opportunities available to professionals under the new Skilled Immigration Act and assist in selecting the appropriate residence permit. Through careful preparation, we ensure accelerated application procedures.

German citizenship can be acquired through naturalization (after a longer stay in Germany) or through descent from German ancestors. Whether and under what conditions dual citizenship is possible depends on various factors – we provide individual consultation on dual citizenship possibilities. By applying for German citizenship, applicants demonstrate the importance Germany holds in their lives. German citizenship brings many advantages: voting rights, permanent right to remain without visas, access to the German education system, and benefiting from a high standard of living.

The German settlement permit is an unlimited residence permit that enables permanent living and working in Germany as well as the right to unrestricted entry and exit. The requirements depend on the original residence permit. For example, the EU Blue Card leads to a settlement permit after just 21 months with appropriate language skills, or at the latest after four years.

Persons from third countries (outside the EU) require an appropriate visa for every entry into Germany. Depending on the purpose of travel, various short-term visas are available: Schengen visas, business visas, visas for trade conferences and sporting events, family visit visas, and visas for medical treatment. We advise on the most suitable visa type and assist with the application process to meet deadlines and avoid legal problems when exceeding the validity period.

On two separate occasions Schlun & Elseven supported me, specifically Christos Sotiri, helped me navigate the visa process. Christos provided a reassuring presence, he answered every question promptly, helped me navigate difficult situations, and gave me a peace of mind that I will be eternally grateful for. I will certainly be recommending their services to anyone in a similar situation, and whether you contract their direct support or not, they are an invaluable resource to anyone navigating immigration in Germany. And if you have the opportunity to work with them directly, I say take it. I know it can be daunting when you first set out to look online for resources and support you can trust, but I can give them my full-fledged endorsement.

I am extremely satisfied with the service I received from Schlun & Elseven, especially from Samir Muratovic. For several years I was debating on whether or not to pursue dual German citizenship by descent due to my unique case. During our first meeting, Samir was very calm, friendly, responsive, knowledgeable, and answered all my questions. Years later when I decided to go through with the process, he was still more than happy to help me start and advised that my case looked good. With his legal help and communication to my local German consulate, I was able to successfully attain dual citizenship quite quickly due to the documents I had. I am beyond grateful to Samir and Schlun & Elseven for their work in advising my case and successfully managing it. I highly recommend them for pursuing dual citizenship by descent.

As retirees seeking residency permits in Germany we were more than happy with the legal advice and service provided by Schlun & Elseven, and particularly Herr Julian Tillmann who guided us through the process of assembling documentation and submitting our application. Since there is no separate 'Retiree VISA' in Germany, and given the reputation of some Auslanderbehorden for long application timelines, we chose to invest in legal assistance rather than attempt the process on our own. All interaction with Herr Tillman was easily accomplished virtually (email or video chat), and in the end, from the time our application package was submitted, we received our permits in 3 months, which we consider a very good timeframe. We're sure it was in large part due to the comprehensiveness of the documentation provided and Herr Tillman's legal commentary.

I enthusiastically endorse and recommend Julie Schafer and Schlun & Elseven for your immigration needs. Julie helped my husband reinstate his German citizenship that he had as a child. She was thorough, knowledgeable, detail oriented and nuanced. I am a lawyer so I am not the best kind of client--impatient and demanding, both--but Julie answered all my questions and helped us stay the course until we received the Certificate of Citizenship from Germany at last. I highly recommend Julie and Schlun & Elseven for all your business and personal needs. You will be singing their praises just like we are!

I cannot recommend Daniel Schewior and his team highly enough. From the very first consultation, they were professional, knowledgeable, and incredibly supportive throughout my entire case. Their expertise, attention to detail, and clear communication made all the difference. They guided me through every step, answered all my questions, and handled the complexities of the case with confidence and precision.
