What is Cyberstalking?

Cyberstalking is the process of harassing and stalking another person using technology and electronic communication over the internet. Offenders use emails, social media accounts including fake profiles, instant messages via mobile phones, internet calls, or other communication channels to pursue their victim persistently. The main goal of most cyberstalkers is to inflict lasting psychological and emotional harm on their victim, and their actions often extend to the victim’s family, friends, and partners.

Cyberstalking and its consequences are often unbearable for victims and those around them and are therefore treated as a serious criminal offense. Nevertheless, proving the offense can be difficult, particularly where the stalker successfully exploits online anonymity. How is Cyberstalking Regulated Under German Law?

Stalking and cyberstalking fall under the offense of stalking (Nachstellung), regulated in Section 238 of the German Criminal Code (Strafgesetzbuch, StGB). Under this provision, anyone who unlawfully stalks another person in a manner likely to seriously affect their way of life faces a prison sentence of up to three years or a fine. This applies where the offender, among other things, persistently seeks out the victim’s physical proximity or attempts to establish contact using telecommunications or other means of communication. The first variant of Section 238 StGB is largely based on the traditional form of stalking, while the second variant, involving the use of telecommunications or other means of communication, establishes the connection to cyberstalking. Certain individual elements of cyberstalking are also separately punishable, such as online threats under Section 241 StGB, malicious gossip under Section 186 StGB, defamation under Section 187 StGB, and insults under Section 185 StGB.

The applicable penalty always depends on the circumstances of the individual case and the severity of the stalking. In particularly severe cases, where the offender places the victim, a relative, or another person close to the victim in danger of death or serious harm to health, the sentence is increased to imprisonment from three months to five years. Some of these offenses can only be prosecuted if the victim submits a formal request to the authorities within a set time limit.
