Dr. Peter Rackow, an adjunct professor at the Georg-August University in Göttingen, is a member of the German criminal law team at Schlun & Elseven Rechtsanwälte PartG mbB. He has extensive experience in issues relating to international legal assistance in German criminal law matters and is co-editor of a commentary on this area. As a member of our legal team, Dr. Rackow contributes to the strategic foundation of criminal defence and the representation of our clients’ interests in cross-border matters.

As a former head of the legal department at the German Police University (DHPol) in Münster, Dr. Rackow is very familiar with the perspective and approach of the investigating authorities. He has worked extensively on issues of German criminal law and criminal procedure and has experience as a criminal lawyer.

Extradition proceedings authorise the transfer of a prosecuted person to another country so that criminal prosecution or execution of a sentence can take place there. In practice, such proceedings are associated with extradition detention. There may be grounds for contesting an extradition order, depending on the substantive and formal requirements of the proceedings themselves and on the requesting state.

Whether extradition, enforcement assistance or other legal assistance measures are involved, legal assistance within the European Union is primarily determined by the fact that national German law is overridden by EU law. Beyond the scope of the EU, the law of the requesting state must always be considered. Dr. Rackow is prepared for both constellations. He is authorised to teach European criminal law and comparative law.

As a member of our practice group for extradition law, Dr Rackow advises our clients in extradition proceedings relating to mutual legal assistance with states outside the EU and in challenging the European Arrest Warrant. In connection with extradition requests, he assists with applications for information and cancellation proceedings at the Commission for the Control of Interpol Files (CCF).

This expertise allows him to develop precisely tailored defence strategies and thus to stand up for your rights and interests in a targeted manner.

If prosecution cannot be avoided, he uses all of his expertise to obtain an acquittal or a dismissal of the case through appropriate motions for evidence or intensive questioning of witnesses.

Dr. Peter Rackow completed his doctorate at the Georg August University in Göttingen on a criminal procedure topic (“Das DNA-Identitätsfeststellungsgesetz und seine Probleme “- “The DNA Identity Determination Act and its Problems”). His postdoctoral thesis on neutral acts in criminal law deals with a problem that is essentially characterised by commercial criminal law.

After his time at the Georg August University, Dr. Rackow worked at the German Police University in Münster-Hiltrup as head of the Department of Criminal Law, Criminal Procedure Law and Criminal Policy and as a lawyer in Hanover and Burgwedel. He has lectured at the University of Administrative Sciences in Speyer and the Philipps University in Marburg, among others, as well as holding a professorship at Saarland University.

As part of the German team, Dr. Rackow implemented an international EU project on the European Investigation Order and is involved in another EU project on the digitalisation of criminal proceedings.
