Custody and Contact Rights

When parents separate, the child’s welfare is the central consideration in every decision. Separation immediately raises fundamental questions about the child’s future: Where will they live? Who makes decisions about their health, education, and upbringing? How is contact with the other parent arranged and maintained? Ms. Trexler advises on joint and sole custody and on the design of contact arrangements — from consensually agreed contact plans through to the court enforcement or variation of existing orders. She represents parents before the family court and works toward solutions that meet the child’s needs without losing sight of her clients’ legitimate interests.

Separation and Divorce

Ms. Trexler guides clients through all stages of the separation and divorce process — from the initial consultation and filing through to the final resolution of all consequential matters. From the outset of the separation period, far-reaching legal questions arise: Who remains in the matrimonial home? How is maintenance arranged during the separation year? What financial claims arise? Ms. Trexler addresses these questions at an early stage and develops a clear strategy together with her clients — whether toward an agreed settlement or through determined representation before the family court. Her advisory services cover:

Spousal maintenance and child maintenance, equalization of accrued gains (Zugewinnausgleich) and asset division, pension rights equalization (Versorgungsausgleich), arrangements regarding the matrimonial home and household contents, drafting and reviewing prenuptial agreements and separation agreements.

Maintenance

Ms. Trexler represents clients comprehensively in all maintenance matters. For child maintenance, she calculates claims on the basis of the current Düsseldorfer Tabelle, taking into account the income of both parents and any care-related factors, and enforces legitimate claims with consistency. For spousal maintenance — whether during the separation period or post-divorce — she assesses the applicable requirements, advises on risks of time-limitation and forfeiture, and negotiates workable arrangements that reflect the financial reality of both parties. Existing maintenance obligations are reviewed for grounds to vary them; where income or life circumstances have changed, Ms. Trexler initiates the necessary steps.

Equalization of Accrued Gains and Asset Division

Divorce brings the statutory matrimonial property regime of the Zugewinngemeinschaft to an end, and the assets accumulated during the marriage must be divided between the spouses. Ms. Trexler assists clients in calculating and enforcing claims to equalization of accrued gains — from establishing the opening and closing asset positions, through asserting disclosure obligations, to the court enforcement of contested claims. She also advises on prenuptial arrangements by which the statutory regime can be individually modified or replaced by a separation of assets. Where shared real estate is involved — including forced sale proceedings — she advises her clients alongside cases involving the division of business interests and other assets.

Protection Against Domestic Violence

Ms. Trexler acts to protect clients in situations of acute risk. Domestic violence — whether physical, psychological, or sexual — requires swift and targeted action. She applies for interim injunctions under the Protection Against Violence Act (Gewaltschutzgesetz, GewSchG) to secure effective protective orders, and handles proceedings for the allocation of the matrimonial home so that those affected can remain in their familiar surroundings. Where needed, she coordinates with counseling services and authorities to ensure support extends beyond purely legal assistance.
